Timeframe to make Common Elements claims
Once a designate has been approved, condominium corporations can use Tarion’s MyHome online portal to easily submit warranty claims online and manage the Performance Audit Tracking Summary, alternatively a claim may be submitted to commonelements@tarion.com. There are three periods during which a claim can be submitted, these are outlined below:
First year
A condominium corporation can submit a First Year Common Elements Form at any time and as many times as required during the first year after the warranty start date. The Performance Audit, which must be conducted by all condominium corporations in the first year, may be submitted instead of the First Year Common Elements Form.
Both First Year Common Elements Form and Performance Audit must be accompanied by a Performance Audit Tracking Summary that references all items included in the warranty claim. The Performance Audit Tracking Summary is a tool designed to track the progress of items submitted to Tarion.
Second year
A condominium corporation can submit a Second Year Common Elements Form at any time and as many times as required during the second year after the warranty start date. Every Second Year Common Elements Form must be accompanied by a Performance Audit and Performance Audit Tracking Summary which must be submitted by midnight of the second year anniversary of the warranty start date.
A Performance Audit Tracking Summary references all items included in the warranty claim. The Performance Audit Tracking Summary is a tool designed to track the progress on items submitted to Tarion.
Year three - seven
A condominium corporation can submit a Major Structural Defects Common Elements Form or Performance Audit at any time and as many times as required after the end of the second year after the warranty start date and before the seventh anniversary.
