Ontario Building Code Warranted by Tarion

By law, all new homes in Ontario built by a licensed vendor or builder come with a statutory warranty under the Ontario New Home Warranties Plan Act (ONHWPA). This statutory warranty protection follows the home and is valid for seven years from the original date of possession, regardless of who owns the home. Coverage for Ontario Building Code (OBC) violations is as follows:

  • Violations of the OBC are covered for one year from the original date of possession
  • Violations of the OBC related to health and safety are covered for two years from the original date of possession

In an effort to improve coordination with municipal building departments, Tarion will now be posting on a quarterly basis a summary of any claims that were deemed warranted and were related to the OBC. This information is being provided to allow building departments an opportunity to better understand the issues that are brought to Tarion's attention after an occupancy permit is granted.
