ADDENDUM: A document included with the Agreement of Purchase and Sale which contains, among other things, information related to the completion of a home and any early termination conditions.
 

AGREEMENT OF PURCHASE AND SALE (APS): The official written contract between a purchaser and a vendor/builder that sets out the conditions of a new home purchase.
 

BUILDER: A person who undertakes the performance of all the work and supply of all the materials necessary to construct a completed home whether for the purpose of sale by the person or under a contract with a vendor or owner. 
 

COMMON ELEMENTS: All of the property in a residential condominium development located outside of unit boundaries. The common elements for a project are identified in the Declaration and Description. 
 

CONCILIATION: A process in which Tarion determines whether an item submitted by a homeowner on a statutory warranty form is covered by the warranty. A conciliation may also be used to determine whether Tarion agrees with a repair or a builder’s proposed repair or settlement offer. 
 

CONCILIATION ASSESSMENT REPORT: A report issued by Tarion after a conciliation that contains Tarion’s assessment of items submitted on a statutory warranty form.
 

CONDOMINIUM: A type of home that is part of a larger project that includes shared areas, or common elements.
 

CONDOMINIUM CORPORATION: The legal entity created for a new condominium project. Among other responsibilities, the condominium corporation manages the common elements warranty. 
 

CONSTRUCTION PERFORMANCE GUIDELINES: A Tarion publication that includes the most commonly reported items and indicates whether they are covered by the warranty. The guidelines are also available in an illustrated, interactive version called Home Explorer.
 

CONTRACT HOME: A single-family home built under Part 9 of the Ontario Building Code where the purchaser owns the land and contracts with a Vendor/Builder to construct the home under a freehold contract.
 

DATE OF POSSESSION: The date a purchaser takes ownership of a new freehold home. This is the date the seven-year warranty work and materials begins. 
 

DECLARATION AND DESCRIPTION: Legal documents provided to the purchaser of a condominium unit. Among other things, they provide a description of the common element boundaries and list the ownership proportion allocated by unit. 
 

DESIGNATE: An individual selected by a homeowner to act as the contact between the vendor/builder and Tarion for matters related to the new home warranty. 


FIRM CLOSING/OCCUPANCY DATE: A date specified in the Addendum by a vendor/builder for the completion of a home that may be extended by a delayed closing date.
 

FREEHOLD HOME: A single-family home built under Part 9 of the Ontario Building Code that is not tied to a vacant land condominium or a common elements condominium corporation, where the vendor owns the land, constructs the home and sells the home via a freehold Agreement of Purchase and Sale.
 

LICENCE APPEAL TRIBUNAL: An independent tribunal created by the Ontario government to provide consumers with an impartial appeal process.
 

MYHOME: An online portal created by Tarion to enable homeowners and condominium corporations to manage their new home warranty. 
 

OCCUPANCY DATE: The date a purchaser takes ownership of a new condominium unit. This is the date the seven-year warranty work and materials begins. 
 

PRE-DELIVERY INSPECTION (PDI): An inspection conducted by the vendor/builder with the purchaser when a new home is ready for occupancy.
 

REGISTRAR BULLETINS: Policies published by Tarion containing information and rules about various matters related to the statutory warranty program. 
 

REPAIR: Activity that the vendor/builder undertakes to resolve a warranty claim item. Repair may involve restoration, alteration, or partial or full replacement of materials or equipment. 


RESIDENTIAL CONDOMINIUM CONVERSION: A project in which an existing non-residential building is converted into a condominium.
 

STATEMENT OF CRITICAL DATES: A section of the Addendum which contains important dates related to the home’s completion and any permitted extensions.
 

STATUTORY WARRANTY FORM: A form used by a homeowner to make a claim under the new home warranty to Tarion. 
 

TENTATIVE CLOSING/OCCUPANCY DATE: A date specified in the Addendum by a vendor/builder for the completion of a home that may be extended under certain conditions.
 

VENDOR: A person or entity who sells a home not previously occupied to an owner. The vendor is responsible for providing the owner with statutory warranty coverage.
