Who can submit a claim
This is a portal to submit a Deposit Protection Claim to Tarion (“deposit claim”) only for the specific projects/builders under receivership that are identified on the first page of the portal. If your project is not listed on the portal, please view our page on pre-possession coverage and claims for guidance on submitting a deposit claim.
How to submit a claim
To submit a claim, visit the electronic form linked at the bottom of this page. If the electronic form does not begin once you select your project on page 1, that means it is too early in your builder’s receivership to submit a deposit claim. Please check back as the portal will be updated as new information becomes available. Please only submit the form once. Once your form is received, it will be assigned to a Tarion representative who will be in contact with you. If you need to make any changes to your claim, you may reach out to your assigned representative. It is important to ensure your email address provided on the form is up to date. If you are a designate representing a purchaser, please contact Tarion at customerservice@tarion.com to obtain a designate form and to submit the deposit claim manually.
What you need to make a claim
Please make sure you have the following documentation ready as you will be required to upload them to your deposit claim electronic form. Please note the form accepts the following types of file format: jpg, jpeg, png, heic, pdf, docx, doc. In addition to the documents below, Tarion may contact you for more information.
- A complete and true copy of the Agreement of Purchase and Sale including all schedules, Amendments and the Statement of Critical Dates.
- Copies of the cashed cheques which you paid to the builder and they deposited (front and back of all cheques including bank drafts)
- Copy of any correspondence you may have received from the receiver or trustee
Claims process for Receivership purchasers only
If it is too early to submit a deposit claim for the project where you purchased a unit, your claim will not be accepted at this time.
Tarion’s review of your deposit claim
Once a complete deposit claim, including all required supporting documentation, is received and processed, Tarion will assess the claim and issue a report outlining Tarion’s assessment on whether the deposit claim is eligible for compensation (this document is called a Conciliation Assessment Report).
If your deposit claim is eligible for deposit protection compensation from Tarion, Tarion will settle the claim directly with you. Within 7 business days of Tarion issuing the Conciliation Assessment Report, Tarion will send you the settlement package for your review and signature. All purchasers who are listed on the Agreement of Purchase and Sale must sign the Claim Resolution and Release. A cheque will be issued within 15 business days of Tarion receiving the properly executed Claim Resolution and Release.
If your deposit claim is not deemed to be eligible for compensation and you disagree with Tarion’s assessment, you can follow the escalation guidelines provided with the Conciliation Assessment Report.
