What you need to know

Several licensed builders within the StateView Homes Group are under receivership and this has impacted several pre-construction home projects. Tarion continues to closely monitor the situation involving several licensed builders within the StateView Homes group. We understand that purchasers of StateView’s pre-construction homes are concerned about the status of the projects and what it means for their purchase agreements.

We encourage you to speak with your real estate lawyer if you have questions about the StateView situation and receivership process. Information about the receiverships is available on the receivers' websites (see hyperlinks below). Tarion will update this notice from time to time.

As of May 2, 2024, Tarion is accepting deposit claims from StateView purchasers for the following pre-construction projects: Highview; Minu Towns; Nao Towns; Nao II; High Crown; Bea Towns; Elm; On the Mark; On the Mark 2; Elia Collection; Queen's Court; and Long Hill. Below you can find more specific information about each project, and how to submit a deposit claim to Tarion. 

How Tarion will support purchasers and homeowners

Under the Ontario New Home Warranty Plan Act, purchasers of new homes have deposit protection coverage up to certain limits in the event that a sale is not completed. For purchase agreements signed on or after January 1, 2018, deposit coverage depends upon the purchase price of the home. For homes with a purchase price of $600,000 or less, deposit coverage is up to $60,000. For homes with a sale price of over $600,000, deposit coverage is up to 10% of the purchase price to a maximum of $100,000.

Purchasers can have confidence that if purchase agreements are ultimately terminated as part of the court-ordered sale process or by transactions completed thereunder, and deposits are not refunded by StateView through the receivership process, then you will be able to submit a Deposit Protection claim to Tarion. There may also be a future claims procedure order made in the receivership proceedings, pursuant to which purchasers who paid deposits to StateView for pre-construction homes will be able to file claims.

For purchasers of StateView's pre-construction homes

The following provides information on the current status of the StateView projects impacted by the receivership.

Highview project

On June 5th, 2023, the court appointed KSV Advisory as the receiver for StateView's (Highview Building Corp Inc.) Highview pre-construction project located at Nashville Road, Kleinburg, ON. 

Highview purchasers who have not received a refund of their deposits may contact Tarion to submit a Deposit Protection claim. You can learn more about the deposit protection offered by Tarion here. Hampton Heights project

On June 15th, 2023, the court appointed RSM Canada as receiver for StateView's Hampton Heights pre-construction project.  On August 18th, 2023, the court approved the sale of StateView’s assets related to the Hampton Heights project. The court order provided for the termination of all existing purchase agreements for the Hampton Heights project. 

Tarion expects that purchasers of homes at the Hampton Heights project will imminently be advised that their purchase agreement is terminated. Based on Information from RSM Canada, it is Tarion’s understanding that there is no prospect of purchasers recovering any of their deposits by submitting claims in the receivership. 

Hampton Heights purchasers who receive written notice that their purchase agreement has been terminated may submit a deposit protection claim to Tarion through our online portal linked below.

Minu Towns, Nao Towns, and High Crown

On June 5th, 2023, the court-appointed receiver, KSV Advisory, was authorized to begin a court-ordered sale process of the land that several of StateView’s pre-construction home projects were to be built on, among other related assets. Those projects include: Minu Towns; Nao Towns; and High Crown.  The sale process has involved the receiver retaining realtors to market the land to maximize value for creditors. 

In November 2023, the court approved the sale of StateView’s assets related to each of the Minu Towns, Nao Towns and High Crown projects. The court orders provided for the termination of all existing purchase agreements for each of the Minu Towns, Nao Towns and High Crown projects. *Note that Nao Towns is distinct from Nao Towns II. The Nao Towns II project is addressed below under a separate heading.  

Tarion expects that purchasers of homes at each of the Minu Towns, Nao Towns and High Crown projects will imminently be advised that their purchase agreements have been terminated. Based on information from KSV Advisory, it is Tarion’s understanding that there is no prospect of purchasers recovering any of their deposits by submitting claims in the receivership. 

Minu Towns, Nao Towns and High Crown purchasers who receive written notice that their purchase agreement has been terminated may contact Tarion to submit a Deposit Protection claim. BEA Towns and Elm

On June 5th, 2023, the court-appointed receiver, KSV Advisory, was authorized to begin a court-ordered sale process of the land that several of StateView’s pre-construction home projects were to be built on, among other related assets. Those projects include: BEA Towns and Elm.  The sale process has involved the receiver retaining realtors to market the land to maximize value for creditors. 

As of March 2023, the court approved the termination of all existing purchase agreements for BEA Towns and Elm. Tarion expects that purchasers have been, or will imminently be, advised that their purchase agreements have been terminated. Based on information from KSV Advisory, it is Tarion’s understanding that there is no prospect of purchasers recovering any of their deposits by submitting claims in the receivership.

Nao Towns II

Those projects include: Nao Towns II.  The sale process has involved the receiver retaining realtors to market the land to maximize value for creditors.

The court orders provided for the termination of all existing purchase agreements for Nao II. Tarion expects that purchasers of homes at Nao II have been, or will imminently be, advised that their purchase agreements have been terminated. Based on information from KSV Advisory, it is Tarion’s understanding that there is no prospect of purchasers recovering any of their deposits by submitting claims in the receivership.

On the Mark project (as distinct from On the Mark 2)

KSV Advisory was appointed receiver of the On the Mark project on June 5th, 2023. The On the Mark project was at an advanced stage of construction at the time of the appointment of the receiver. Consequently, the On the Mark sale process is progressing in a different manner than the other projects for which KSV Advisory is acting as receiver.   

On September 14th, 2023, the court approved the sale of the On the Mark project to a company that will offer On the Mark purchasers the option to complete their original purchase agreements under amended terms. Tarion encourages On the Mark purchasers to discuss this option with their real estate lawyer.

Purchasers who do not accept the option to complete their On the Mark purchase agreement may, once termination of their purchase agreement is finalized, can submit a deposit protection claim to Tarion by proceeding to our online portal linked below.

On the Mark 2

The receiver, KSV Advisory, has filed an assignment in bankruptcy in respect of On the Mark, the vendor under one or more purchase agreements in connection with the On the Mark 2 project. Purchasers of a pre-construction home at the On the Mark 2 project may contact Tarion to submit a Deposit Protection claim. Elia Collection, Queen's Court and Long Hill

The vendors of these three projects are, respectively, StateView Homes (Elia Collection) Inc., StateView Homes (Queen’s Court) Inc., and StateView Construction Ltd. These three vendor entities are not in receivership, however in April 2024 Tarion received confirmation that there is no reasonable prospect of these projects being completed.

Purchasers who entered into a purchase agreement with StateView for a home in the Elia Collection, Queen’s Court, or Long Hill projects may contact Tarion to submit a Deposit Protection claim. Owners of homes completed by StateView

Purchasers who have already been given occupancy of a completed home by StateView should continue to submit warranty claim forms (eg. 30-Day, Year-End, Second Year, and Major Structural Defect forms) in the usual course and according to the relevant deadlines.

Homeowners can have confidence that Tarion will process warranty claim forms, schedule and conduct conciliation inspections and backstop StateView’s warranties if the builder is unable to fulfill their warranty commitments.
